All goods and services sold by us are subject to the terms of trade set out below. We may vary these terms at any time, though any other variation must be agreed to in writing. References to "we", "our" or "us" refer to Think Green (NZ) Limited. References to "you" and "your" refer to the customer.
While we endeavour to supply accurate information on this site, errors and omissions may occur. Think Green does not accept any liability, direct or indirect, for any loss or damage resulting from any advice, opinion, information, representation or omission on this site. You are solely responsible for the actions you take in reliance on content on, or accessed through, this site.
Acceptance
You will be deemed to have read and accepted these terms when you confirm an order by clicking "SUBMIT" or "I ACCEPT". Once your order has been accepted by us, a binding contract is formed for the supply of goods or services on these terms.
Refusing or Cancelling Orders
If goods or services ordered are no longer available, we reserve the right to refuse or cancel an order. If there is an error in a product listing or a technical error in processing your order, we also reserve the right to cancel. This right applies even to orders that have already been accepted.
Price and Payment
You must pay the price specified on our website at the time your order is accepted. All payments are made by credit card (Visa, Mastercard, Amex). We may contact you to confirm your card details. All prices are in New Zealand dollars and are inclusive of GST. You are responsible for any other applicable taxes, import duties, levies or tariffs.
Freight and Handling
Freight and handling charges apply as follows:
- NZ standard delivery: $5.00 per order
- NZ rural delivery: $11.00 per order
- Free freight on orders over $75
- Gift vouchers delivered within NZ incur no freight charge
Delivery to the Chatham Islands and Stewart Island is excluded. Please contact our Customer Services team for alternative freight options. Freight charges for deliveries outside New Zealand (North & South Island) will be advised upon receipt of your order and confirmed with you before dispatch.
Order and Delivery
We will endeavour to deliver goods within 5 days of receiving and accepting your order, subject to stock availability. If a delay is anticipated, we will advise you of the reason and estimated delivery date, and ask you to confirm or cancel your order. We will not be liable for any delays in delivery of goods or services.
Property and Risk
Property and risk in goods will pass to you upon delivery to your specified delivery address.
Returns Policy
Should you change your mind, we will happily provide an exchange or credit voucher subject to the following conditions:
- Goods are returned within 7 days of delivery
- Goods are in their original condition as purchased
- Returned goods are accompanied by a receipt
Sale goods are not returnable. Exchanges via post or courier are at the expense of the customer.
If you have selected the wrong colour, size, or simply changed your mind, please contact us as soon as possible. If your order has not yet been dispatched, we are happy to make changes. Once an order has been logged with the courier, we are unable to make changes, but please contact us and we will do our best to help.
For hygiene reasons, we are unable to accept returns on certain items including nipples, sippy spouts, potties, toilet trainers, and breast pumps.
If goods are faulty, we will meet our obligations under the Consumer Guarantees Act. Proof of purchase is required and faulty goods must be returned as soon as possible. Customers in New Zealand (North & South Island) will not be charged freight on faulty returns. Customers outside of New Zealand are responsible for freight and handling charges for returning goods and receiving any repaired or replacement items. We will advise you of these costs before dispatching any replacement goods.
Liability
To the extent permitted by law:
- All warranties, representations and guarantees (whether express, implied or statutory) are excluded
- We will not be liable for any indirect losses or consequential damages
- Our liability is limited to the replacement, or replacement cost and delivery cost, of the relevant goods at our option
If you are not acquiring goods or services for business purposes, you may have rights under the New Zealand Consumer Guarantees Act 1993, in which case the above exclusions will not apply to the extent they are inconsistent with those rights. The Consumer Guarantees Act 1993 does not apply to goods or services acquired for business purposes.
Governing Law
These terms of trade are governed by the laws of New Zealand.
Business Name
Think Green Ltd will appear on your statement for all orders placed on the Haakaa website.
Changes to the Agreement
Think Green reserves the right to alter, modify or update these terms at any time. Please do not assume that the same terms will apply to future orders.
